A: The insurer typically schedules an "independent medical examination" when it desires to cut off, cut down or cut short your benefits. The insurer pays several hundred dollars or more to a doctor it likes. That doctor is not going to treat you. That doctor is not planning to help you. That doctor has agreed to be "hired" for pay by the insurer and therefore works for the insurer. In 2010, our firm promoted a new law allowing injured workers to protect themselves with a new right to video or audio record the exam by the insurer's doctor. That law passed. You have the right to video or audio record any independent medical exam required by the insurer.
